CMS COVID-19 VACCINE MANDATE NOW APPLIES TO HEALTHCARE WORKERS IN TEXAS
THE LATEST LEGAL UPDATE
In seesaw fashion, the U.S. District Court for the Northern District of Texas has now dismissed the December 2021 lawsuit that was filed by the state of Texas against the CMS Healthcare Vaccine Mandate. As a result, this removes the injunction against the Mandate and it appears that healthcare providers in Texas are no longer excluded. We expect to see more clarification soon and will provide more specific details about the rules and timing shortly.
A BRIEF HISTORY OF THE TEXAS LEGAL CHALLENGES
In December 2021, the State of Texas filed suit against U.S. Health & Human Services (HHS) Secretary Xavier Becerra to block the CMS mandate. As a result, the U.S. District Court for the Northern District of Texas issued a preliminary injunction on the mandate, meaning it could not be implemented until the case was ultimately decided. HHS appealed the decision and filed a motion to remove the injunction. This particular case was not one of the separate lawsuits decided by the Supreme Court on January 13. Since then, the U.S. District Court for the Northern District of Texas has dismissed the case, and the CMS Vaccine Mandate will now likely be implemented and enforced nationwide.
